Welcome to pasalnepal.com.np also hereby known as “we”, “us”, “our” or “Pasal Nepal”. We are an online marketplace and these are the terms and conditions governing your access and use of Pasal Nepal along with its related services and tools ( the “Site”). By using the Site, you hereby accept these terms and conditions (including the liked information herein) and represent that you agree to comply with these terms and conditions (the “User Agreement”). This User Agreement is deemed effective upon your use of the Site which signifies your acceptance of these terms. TERMS OF SERVICE USE

 

AGE ELIGIBILITY

The Services are not available to minors under the age of eighteen (18), of unsound mind or with intellectual disability, or to any Users suspended or removed from the Pasal Nepal System by Pasal Nepal for any reason whatsoever. If you are disqualified as per the preceding sentence, you shall not be permitted to avail of the Services or use the Site. You represent that you are of legal age to form a binding contract and are not a person barred from receiving the Services under the laws as applicable in Nepal. Notwithstanding the foregoing, if You are below the age of eighteen (18) years, please read through these Terms of Use with your parent or legal guardian, and in such a case these Terms of Use shall be deemed to be a contract between Pasal Nepal and Your legal guardian or parent and to the extent permissible under applicable laws, enforceable against you. We reserve the right to refuse access to use the Services offered at the Site to new Users or to terminate access granted to existing Users at any time without according to any reasons for doing so. In addition, You shall not have more than one active Account (defined here under) on the Site nor transfer Your Account to another person.

PRICING, AVAILABILITY AND ORDER PROCESSING

The prices of most of the products listed are inclusive of VAT. Items added to a shopping cart or basket always reflect the most recent price displayed on the item’s product detail page. Please note that the price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart does not reserve the price shown at that time.

 

We are determined to provide the most accurate pricing information on the Site to our Users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the Site. As such, we reserve the right to refuse or cancel any order. If an item is mispriced, we may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation. FEES AND SERVICES

Pasal Nepal also reserves the right to take legal action in case of non-payment of fees by you to Pasal Nepal.

Please note that you further agree and acknowledge that you shall be bound by and agree to fully indemnify and hold us against any losses arising from the use of or access to the Site through your account.

 

BREACH

We can terminate your membership or access to your account if:

1. If you breach the User Agreement or the documents it incorporates by reference;

2. If Pasal Nepal is unable to verify or authenticate any information you provide; or

3. If it is believed that your actions may cause legal liability for you, other Users, or Pasal Nepal, Pasal Nepal may at any time at its sole discretion reinstate suspended Users.

 

 

ELECTRONIC COMMUNICATION

When you visit the Site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures,s and other communications that we provide to you electronically satisfy any legal requirement that such communication be in writing.

 

CONTENT LICENSE

When you give us content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free sub-licensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future. We need these rights to host and display your content.

 

ARBITRATION

If any dispute arises between you and Pasal Nepal during your use of the Site or thereafter, in connection with the validity, interpretation, implementation, or alleged breach of any provision of the User Agreement, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by Pasal Nepal.

 

GOVERNING LAW

The User Agreement shall be governed by and construe both the laws of Nepal.
